29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a written fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Miguel Zambrano Construction,5246 Rangeland, Loveland, CO: On or about May 8, 2012, the controlling employer did not ensure the use of appropriate fall protection while employees of a sub-contractor framed a two story residential home. Employees of the sub-contractor were observed framing the walls on the second story without conventional fall protection or an alternative fall protection plan.  Condition exposed two employees to a fall hazard of approximately 8 feet.    Note:  When the employer can demonstrate that it was infeasible or created a greater hazard to use one of the systems mentioned above, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 must be developed, written, and implemented.    Note: Miguel Zambrano Construction was previously cited for a repeated violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 313417271, citation number 1, item number 2, issued on March 10, 2010, with respect to a workplace located at 440 Cable Street, Lochbuie, CO.    Abatement Note:  Abatement certification and documentation is required for this item (See enclosed Abatement-Certification Letter).
