29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Miguel Zambrano Construction @ 4909 Boca Del Rio, Fort Collins, CO 80526: On and before June 4th, 2013, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Framing employees were permitted to work on the exterior top plate while setting trusses. The condition exposed employees to fall hazards of approximately 10 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a) Miguel Zambrano Construction @ 4909 Boca Del Rio, Fort Collins, CO 80524: On and before June 4th, 2013, the exposing employer did not ensure that fall protection systems were utilized by employees engaged in framing operations while walking and working on the exterior top plate, setting trusses on a single-family home under construction. Employees were not utilizing a fall protective system. Employees were exposed to fall hazard of approximately 10'. Miguel Zambrano Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 555871, citation number 1, item number 2, and was affirmed as a final order on August 24th, 2012 with respect to a workplace located at 7033 Bellwood Ln, Fort Collins, CO 80525.
