29 CFR 1910.134(d)(1)(ii): The employer shall select a NIOSH-certified respirator. The respirator shall be used in compliance with the conditions of its certification. a. Bagging Building - On or about June 8, 2012, employees were provided with dust masks (IUY Classic - 22150) that were not NIOSH - certified respirators. Employees were thereby potentially exposed to health hazards.

29 CFR 1910.141(a)(4)(ii): All sweepings, solid or liquid wastes, refuse, and garbage shall be removed in such a manner as to avoid creating a menace to health and as often as necessary or appropriate to maintain the place of employment in a sanitary condition. a. Bagging Building/Northside/Behind Machine # 1 - On or about June 8, 2012, employees were working in unsanitary conditions when sweepings of mineral materials were not removed. Employees were thereby exposed to respiratory system irritations.
