Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or caught between forklifts and other surfaces associated with the rollover of fork lift trucks without the use of the operator restraint systems:     (a) In the receiving dock area on or about May 23, 2012, the seat belt was not worn while operating a Tusk forklift to load pallets of recycled paper onto the bed of a truck.

29 CFR 1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.:      (a) In the carpenters' shop on or about May 23, 2012, and at times prior thereto there was no guard for the chuck on a Dayton 20 inch Drill Press, model number N919F.  The drill press was used to drill wood and holes in aluminum brackets.

29 CFR 1910.213(c)(2): Each hand-fed circular ripsaw was not  furnished with a spreader to prevent material from squeezing the saw or being thrown back on the operator:      (a) In the carpenters' shop on or about May 23, 2012, and at times prior thereto there was no spreader on a Delta Industrial Unisaw, 10 inch.  The saw was used to rip hardwoods.

The saw was used to rip hardwoods.

29 CFR 1910.213(p)(4): Belt sanding machines were not provided with guards at each nip point where the sanding belt runs on to a pulley. These guards did not effectively prevent the hands or fingers of the operator from coming in contact with the nip points. The unused run of the sanding belt were not guarded against accidental contact:      (a) In the carpenters' shop on or about May 23, 2012, and at times prior thereto there was no guard at the nip points where the sanding belt run onto a pulley on a Delta 420A floor standing belt and disc sander, serial number 08068289.  Reportedly, there was a guard/workrest on the sander when it was first used.
