29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) Northeast end of site, at entrance to the north parking area; On or about June 4, 2012 and at times prior thereto, an employee wearing shorts and sneakers was operating a rammer/tamper to compact backfill material over underground utilities. b) Northeast end of site, at entrance to the north parking area; On or about June 4, 2012 and at times prior thereto, an employee was operating a rammer/tamper to compact backfill material over underground utilities and was not wearing eye protection. c) Northeast end of site, at entrance to the north parking area; On or about June 4, 2012 and at times prior thereto, an employee wearing shorts and sneakers was standing in close proximity to another employee operating a rammer/tamper to compact backfill material over underground utilities. d) Northeast end of site, at entrance to the north parking area; On or about June 4, 2012 and at times prior thereto, an employee was standing in close proximity to another employee operating a rammer/tamper to compact backfill material over underground utilities and was not wearing eye protection. Note: Abatement certification is NOT required for this item.
