OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, when transferring and filtering hot oil from the deep fryer kettle, employees were exposed to burns from the hot fryer grease:    a)  Titusville Dairy Queen, on or about June 11, 2012, an employee was burned when the heating element of the Star Max Deep Fat Fryer (model #301HLD) fell into the kettle, splashing hot oil.  The mechanism to lock the heating element in a vertical position failed and had not been maintained and/or repaired to ensure it was in proper working condition.    b)  Titusville Dairy Queen, on or about June 11, 2012, employees filtered the hot oil by removing the pan from the kettle, pouring it through the filter into another pan and then putting the pan with the filtered oil back into the kettle.  The employees were not trained to safely filter and transfer the hot oil in accordance with the manufacturer's recommendations.

29 CFR 1910.132(d)(1)(i):     When hazards were determined to be present, or likely to be present, which necessitated the use of personal protective equipment (PPE), the employer did not select, and have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment:    a)  Titusville Dairy Queen, on or about June 11, 2012, the employer determined that the hot oil from the deep fryer presented a hazard but did not select or provide employees with a protective apron, constructed of material such as, but not limited to, rubber or rubberized fabric.  Employees did not use an apron that would protect them from burns from splashing or splattering hot oil when filtering and transferring it from the Star Max Deep Fat Fryer, model 301HLSMA.
