29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances: (a) Inside the shop under renovation on or about June 18, 2012, and at times prior thereto, soap was not provided onsite for employees that worked with Portland cement. Employees were not allowed to use the hotel's restrooms. They had to wash inside the shop area.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) Inside the shop under renovation on or about June 18, 2012, and at times prior thereto, gloves and eye protection were not used while mixing Portland cement with water and applying the cement to install new floor tiles.
