29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  (a.) At the back of the building on a scaffold platform, eye protection was not worn while using a hammer to remove wood formwork for a concrete pour, exposing employees to the hazard of being struck by wood splinters or nails.  (b.) In the north side interior of the building on the first level, eye protection was not worn while using a hammer to remove formwork from concrete, exposing employees to the hazard of being struck by wood splinters or nails.

29 CFR 1926.451(e)(4)(i): Stairrails consisting of a toprail and a midrail were not provided on each side of each scaffold stairway:  (a.) At the back of the building near the south end, there was no midrail on the scaffold stairway as there was a single rail about 42 inches above the treads. There were 14 risers to the second level platform that was 9 feet, 8 inches high. Employees were exposed to the hazard of falling from elevations that varied up to 9 feet, 8 inches from the scaffold platform to the ground.  (b.) At the back of the building near the middle, there was no toprail on the scaffold stairway as there was a single rail about 19 to 20 inches above the treads. There were 11 risers to the second level platform that was about 9 feet, 8 inches high. Employees were exposed to the hazard of falling from elevations that varied up to 9 feet, 8 inches from the scaffold platform to the ground.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and steps were not parallel, level, and uniformly spaced when the ladder is in position for use:  Near the south end interior first level of the building, ladder rungs were not evenly spaced on a job made ladder as they varied from 15 to 18 to 19 inches apart.  Employees that used the ladder to access a platform were exposed to the hazard of falling from a height of about 10 feet to the soil below.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):  Near the south end interior first level of the building, the 10 foot long job made ladder was not about 2.5 feet between the foot and top support as it was about 7 feet between the foot and top support. Employees that used the ladder to access a platform were exposed to the hazard of falling from a height of about 10 feet to the soil below.
