29 CFR 1910.178(p)(1):   If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it had been restored to safe operating condition:    At the site, on or about June 11, 2012 and at times prior thereto, employees utilized a propane-powered industrial truck (Brand TCM, Model FC815P9) inside the facility that was in disrepair with a broken left arm of the carriage bar, exposing employees to a struck-by hazard.

29 CFR 1910.178(q)(7):   Industrial trucks are not examined before being placed in service, and are placed in service if the examination shows any condition adversely affecting the safety of the vehicle.  Such examinations are not made at least daily.  Defects when found are not immediately reported and corrected:    At the site, on or about June 11, 2012 and at times prior thereto, employees utilized a propane-powered industrial truck (Brand TCM, Model FC815P9) inside the facility that was in disrepair with a broken left arm of the carriage bar, exposing employees to a struck-by hazard, as the forklift is not inspected daily.

29 CFR 1910.305(g)(2)(iii):   Flexible cords and cables were not connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws:    At the site, on or about June 11, 2012, and at times prior thereto, on the aerial platform lift used in the paint spray booth, the electrical wiring on the lift control box was exposed for approximately 4 inches, exposing employees to electrical shock when energized.
