DBA BLUE OX ROOFING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313467516, CITATION NO. 2, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL ORDER ON 09/15/2009, WITH RESPECT TO A WORKPLACE LOCATED AT 1 WALNUT STREET, LOCKPORT, NY. 14094. 29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: a) The Campus Bookstore at Niagara University, three (3) employees observed doing roofing work immediately adjacent to the edge of the roof and no type of fall protection was being utilized by any of the employees. The employees were exposed to falls of 15' 4" to the ground below. NO ABATEMENT CERTIFICATION NEEDED
