29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:      a) On or about 04/09/13, on the south section of the flat roof at the former Key Bank, Black Rock/Riverside Branch, 52 Amherst St., Buffalo, NY:  An extension cord was plugged into a 120 volt-ac receptacle on a Briggs and Stratton , "Storm Responder",  5500 Watt Portable Generator. The extension cord supplied power to a Bosch Hammerdrill which employees used to drill holes for rawls, and also to a DeWalt screwgun. No GFCI or assured equipment grounding program was being used.      ABATEMENT CERTIFICATION REQUIRED

DBA BLUE OX ROOFING WAS PREVIOUSLY CITED FOR A  VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS  EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION  NUMBER 313467516, CITATION NO. 2, ITEM NO. 1, AND WAS AFFIRMED AS A  FINAL ORDER ISSUED ON 09/15/2009, WITH RESPECT TO A WORKPLACE LOCATED  AT 1 WALNUT STREET, LOCKPORT, NY 14094.      RJM ROOFING INC. DBA BLUE OX ROOFING WAS PREVIOUSLY CITED FOR A  VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS  EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION  NUMBER 473879, CITATION NO. 1, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL  ORDER ISSUED ON 03/13/2013, WITH RESPECT TO A WORKPLACE LOCATED AT  5795 LEWISTON ROAD, NIAGARA UNIVERSITY, NY 14109.      29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    a) On or about 04/09/13, on the south section of the flat roof at the former Key Bank, Black Rock/Riverside Branch, 52 Amherst St., Buffalo, NY:  Three employees were exposed to a potential fall of approx. 11 ft. from the edge of the lower roof while in the process of installing an EPDM Rubber Roofing System.  No fall protection system was utilized.    NO ABATEMENT CERTIFICATION REQUIRED
