29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:    On or about June 18, 2012, the employer did not ensure the scaffolds were constructed correctly. The scaffolds supporting three employees did not have base plates for support. The scaffolds were set on mud sills (one of which was broken) directly positioned to the ground. Employees were exposed to fall hazards due to instability of the scaffolds.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    On or about June 18, 2012, one employee was observed climbing onto a scaffold  platform where no ladder or direct access from another scaffold was provided. The employee was exposed to a fall hazard approximately 13-feet to the ground.

The scaffolds were not fully planked along with guardrails and base plates missing.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section:    On or about June 18, 2012, an employee was observed working below a scaffold with another employee working above. The scaffold was not installed with toeboards or canopy structures that could contain or deflect the plastering mud and shovel. The employee was exposed to struck-by hazards.

CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    On or about June 18, 2012, two employees were observed working on scaffold platforms not protected from falls by the use of personal fall arrest systems or guardrail systems;        a)  In front of the Bldg. 32 on the left side, one employee was observed working on scaffold platform without any personal fall            arrest systems or guardrail systems. The employee was exposed to a fall of approximately 16-feet, 6-inches to the ground.        b)  In front of the Bldg. 32 on the right side, one employee was observed working on scaffold platform without any personal fall            arrest systems or guardrail systems. The employee was exposed to a fall of approximately 12-feet, 10-inches to the ground.
