29 CFR 1910.37(a)(2)  Exit routes were not arranged so that employees did not have to travel toward a high hazard area:    a) The employer failed to provide an adequate means of egress that would allow employees to evacuate safely during an emergency in which a gasoline fueling storage and dispensing system was maintained 16 feet from the nearest exit route leading to an exit.    b) The employer failed to provide an adequate means of egress that would allow employees to evacuate safely during an emergency in which a gasoline fueling storage and dispensing system was maintained 29 feet from the nearest exit.

29 CFR 1910.106(e)(2)(ii)(b)(2):     The quantity of liquid that may be located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building exceeded 120 gallons of Class IB, IC, II, or III liquids in containers:    a) On June 20, 2012 the employer stored at least 391 gallons of waste/fresh gasoline and 1000 gallons of waste/fresh oil inside the Garden Repair Center (GRC).    b) On June 27, 2012 employer stored 401 gallons of waste gasoline within a Waste Storage Area.

29 CFR 1910.133(a)(3):     The employer did not ensure that each affected employee, who wore prescription lenses while engaged in operations that involved eye hazards, used protection that incorporated the prescription in its design, or wore eye protection over the prescription glasses or protective lenses with side shields.       a) The employer failed to provide employees with eye protection over prescription glasses to protect against eye hazards caused by flying objects/particles along with chemical splashes while handling gasoline and oil when performing maintenancing on lawnmowers, saws and trimmers within the Garden Repair Center (GRC).

29 CFR 1910.307(c)(2)(i):     Equipment shall be approved not only for the class of location, but also for the ignitable or combustible properties of the specific gas, vapor, dust, or fiber that will be present. Note to paragraph (c)(2)(i) of this section: NFPA 70, the National Electrical Code, lists or defines hazardous gases, vapors, and dusts by "Groups" characterized by their ignitable or combustible properties.    a) On or about February of 2012, the electrical outlets/wiring was not approved for the hazardous (classified) location when a fueling storage and dispensing system consisting of a flammable liquid (gasoline) and combustible liquid (oil) was installed.
