29 CFR 1926.501(b)(15): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Jobsite, 600 Liberty Avenue, Pittsburgh, PA: On or about June 29, 2012, during construction activities, the employer did not ensure that employees used fall protection systems/devices in all areas of a roof where exposed to falls of approximately 50 feet. An employee was on the roof watching landscaping employees install plants on the roof and had a guardrail along one roof edge, but had no other fall protection systems/devices in use along other roof edge areas.

29 CFR 1926.503(c)(3): The employer did not ensure that retraining was done where inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee has not retained the requisite understanding or skill: a) Jobsite, 600 Liberty Avenue, Pittsburgh, PA: On or about June 29, 2012, during construction activities, the employer did not ensure that employees had an appropriate level of knowledge regarding fall protection systems/devices where exposed to falls of approximately 50 feet. An employee was on the roof watching landscaping employees install plants and had a guardrail along one roof edge, but had no other fall protection systems/devices in use along other roof edge areas and tried to stay at least 6 feet away from any exposed roof edge. It was believed that this was adequate for fall protection during this work.
