Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about July 9, 2012 - at the above addressed jobsite, employees performing roofing operations approximately eleven (11) feet nine (9) inches above the ground were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR 1926.451(g)(1)(iii): Each employee on a crawling board (chicken ladder) shall be protected by a personal fall arrest system, a guardrail system (with minimum 200 pound toprail capacity), or by a three-fourth inch (1.9 cm) diameter grabline or equivalent handhold securely fastened beside each crawling board; a. On or about July 9, 2012 - at the above addressed jobsite, an employee was conducting roofing operations from a crawling board (chicken ladder) approximately twelve (12) feet above the ground, the employee was not protected from falls, thereby exposing the employee to a fall hazard.
