29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: (a) Western Framing at 4481 & 4491 Winona Ct., Denver, CO 80211: On or before June 28, 2012 the employer did not ensure the employees were protected from injury, in that employees engaged in construction activities on a 2nd level of a residential home had exposure to fall hazards from wall openings on each half of the duplex. This condition exposed the employees to the hazard of a fall of approximately 12 feet. (b) Western Framing at 4481 & 4491 Winona Ct., Denver, CO 80211: On or before June 28, 2012 the employer did not ensure the employees were protected from injury, in that employees engaged in construction activities on the 2nd level of Unit 4481had exposure to fall hazards from a staircase floor opening. This condition exposed the employees to the hazard of a fall of approximately 11 feet.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: (a) Western Framing at 4481 & 4491 Winona Ct., Denver, CO 80211: On and before June 28, 2012, the employer did not ensure that employees used a ladder in a manner for which it was designed in that a 10 foot tall step ladder was used as an extension ladder and a means of access and egress to a 2nd story level of a new residential building under construction. This condition exposed the employees to the hazard of a fall of up to 12 feet.
