29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph (b).  Note:  If using these systems was infeasible or created a greater hazard, the employer did not develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502:    a)  Victor Araujo Construction at 2232 Hecla Drive, Louisville, CO 80238:  On or before August 20, 2011, the employer did not ensure that employees were using fall protection when setting the last gable truss. Condition exposed employees to fall hazards of up to 12 feet.

29 CFR 1926.404(f)(6):  The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a)  Victor Araujo Construction at 2232 Hecla Drive, Louisville, CO 80027:  On or before July 14, 2012, the exposing employer did not ensure that the path to ground was permanent and continuous for the blue extension cord used with the 110 volt skilsaw.  Condition exposed employees to the hazard of getting struck by falling loads.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval:  Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly:    a)  Victor Araujo Construction at 2232 Hecla Drive, Louisville, CO 80027:  On or before July 14, 2012, the exposing employer did not ensure that the attachment to the Gradall JLG model 534D9-45, consisting of an extension to handle trusses, had received the forklift manufacturer's approval.  The attachment extended the rigging connection point out by about 15', and the modified load capacity charts were not posted or available.  The attachment was manufactured by RLS Specialty Fabrication, serial number 15106791.  This lattice boom style attachment was used to lift roof trusses and extend them above the top plate for this ranch style house.  The forklift operator did not know the weight of the roof trusses, nor the capacity of the forklift at this height and reach using this attachment   Condition exposed employees to the hazard of getting struck by falling loads.
