29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employee(s) provided with an alternative fall protection measure:  (a)  Victor Araujo Construction at 2162 Wagon Way, Louisville, CO 80027:  On July 12, 2012, the exposing employer did not ensure that employees were protected from injury in that four employees were erecting and securing exterior walls on the second level of a residential home without using a fall protection system.  This condition exposed the employees to a fall hazard of approximately 10 feet.  (b)  Victor Araujo Construction at 2162 Wagon Way, Louisville, CO 80027:  On July 12, 2012, the exposing employer did not ensure that employees were protected from injury in that one employee use a cross-brace of the housing framework to climb up to the second level of a residential home.  This condition exposed the employee to a fall hazard of approximately 10 feet.  Abatement Note:  Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)  Victor Araujo Construction at 2162 Wagon Way, Louisville, CO 80027:  On July 12, 2012, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment made by a competent person.  Four employees were erecting and securing exterior walls on the second level of a residential home without using a fall protection system.  This condition exposed the employees to a fall hazard of 10 feet.  Abatement Note:  Abatement certification is required for this item (see enclosed Certification of Corrective Action Worksheet).
