OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to caught between, struck by, and fall hazards while riding inside the bucket of an excavator: a) Employees were not provided with safe means of access and egress while riding in and out of the trench inside the bucket of the Hyundai 160 LC-3 excavator. Among others, feasible and acceptable method of abatement would be to never allow employees to enter the bucket of an excavator or any other similar equipment as described in the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators. No abatement certification or documentation is required for this item.
