29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):    a) On or about October 17, 2023, employees were not protected from the hazard of cave-ins by an adequate protective system while working in a trench having a depth of approximately 8 to 10 feet.  Mauro Sewer Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1500388, citation 2, item 1, and was affirmed as a final order on March  29, 2021, with respect to a worksite located at Cherry and Winser Streets, Park Ridge, Illinois.   Mauro Sewer Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1323884, citation 1, item 2, and was affirmed as a final order on December 19, 2018, with respect to a worksite located at 2266 Cedar Street, Des Plaines, Illinois.    No abatement certification or documentation required for this violation.

29 CFR  1926.652(c)(2)(ii): Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer were allowed without the manufacturer's specific written approval:  a) on or about October 17, 2023, the employer deviated from specifications, recommendations, and limitations of a trench box/shield system without the manufacturer's written approval where the employer used a trench box with makeshift pins (i.e. bolts and washers) to construct the trench box and connect spreaders to the box sidewalls.  No abatement certification or documentation required for this violation.

No abatement certification or documentation required for this violation.
