29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA. a) On or about July 23, 2012, North and South bound lanes of N. Clybourn Avenue, the employer did not conform with Part VI of the MUTCD Section 6H.11 in that employees were allowed to work in and near moving traffic without the use of signage warning approaching road users of the presence of a flag person. Thereby the employees were exposed to the hazard of being struck by moving vehicles. b) On or about July 23, 2012, North and South bound lanes of N. Clybourn Avenue, the employer did not conform with Part VI of the MUTCD Section 6F.20 in that employees were allowed to work in and near moving traffic without the use of signage warning approaching road users of a one lane road. Thereby the employees were exposed to the hazard of being struck by moving vehicles. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.201(a)(1): The use of flaggers, signaling by flaggers or the warning garments worn by flaggers did not conform to Part IV of the manual on Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA, which are incorporated by reference. a) On or about July 23, 2012, North and South bound lanes of N. Clybourn Avenue, the employer did not conform to Part VI of the MUTCD Section 6E.4, when an employee directing traffic in the North and South bound lanes was not provided with a sign paddle or flag to safely transfer vehicular traffic. The employee thereby was exposed to the hazard of being struck by moving vehicles. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
