29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides: a) Brookdale Senior Living - Freedom Village: An employee, (Housekpeeping) while disposing of garbage in a trash compactor, was exposed to a four foot fall from a platform at a 16 inch opening in the railing next to the trash compactor as a chain reaching 26 inches at its lowest point was present as fall protection. The employer did not ensure that the open sided platform was guarded by a standard railing or equivalent. On or about August 1, 2012. b) Brookdale Senior Living - Freedom Village: An employee, (Housekpeeing) while disposing of garbage in a trash compactor, was exposed to a four foot fall from a platform at a 16 inch opening in the railing on the opposite side of the compactor as a chain mounted on the railing was not in use. The employer did not ensure that theopen sided platfrom was guarded by a standard railing or equivalent. On or about August 1, 2012.

29 CFR 1910.1030(h)(2)(i)(C): Employee training records for bloodborne pathogens did not include the qualifications of persons conducting the training: a) Brookdale Senior Living - Freedom Village: Employees (Nursing Staff) who provided direct patient care by performing tasks such as administering injections were potentially exposedus to bloodborne pathogens. The employer provided bloodborne pathogens training but did not include the qualificatios of those individuals conducting the training. On or about August 1, 2012. b) Brookdale Senior Living - Freedom Village: Employees (Housekeeping Staff) who cleaned up potentially infectious materials such as blood were potentially exposed to bloodborne pathogens. The employer provided bloodborne pathogens training but did not include the qualifications of those individuals conducting the training. On or about August 1, 2012.
