29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides, or were not guarded with the standard railings (or equivalent) and toeboards; or were not guarded with standard railings (or equivalent) and toeboards. Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a) National Park Service Lassen Volcanic National Park - Bldg. 133 - On or about June 20, 2012 and at times prior thereto, a section of the Shop's south mezzanine was not protected by a railing on the open side. b) National Park Service Lassen Volcanic National Park - Bldg. 133 - On or about June 20, 2012 and at times prior thereto, the Middle Bay 's south and north mezzanines did not have a toe board where employees could pass underneath.
