29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: A. Radical Roofing worksite located at Seminary Rd. and Wood Creek Ct., Perrysburg, Ohio: On or about July 24, 2012, the employer did not ensure an employee was wearing proper eye protection while operating a pneumatic nail gun while installing weatherproofing on the south side of the residential structure. The employee was exposed to potential flying object hazards while operating the pneumatic fastener.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. A. Radical Roofing worksite located at Seminary Rd. and Wood Creek Ct., Perrysburg, Ohio: On or about July 24, 2012, the employer did not ensure employees were protected from falls while installing weatherproofing on the two story residential structure. The employees were exposed to a fall distance of approximately 11.00 feet from the 10/12 pitch roof. Radical Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501, which was contained in OSHA inspection number 110616, citation number 1, item number 2 and was affirmed as a final order on January 19, 2012, with respect to a workplace located at Oregon, OH.
