29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. a) 5th floor, south side, elevator shaft: An employee was instructed to fill concrete into formwork pockets at the edge of the building and adjacent to an open elevator shaft. The employee laid a wood plank across the shaft opening to walk across and work from.. The employee was not protected from falling into the shaft opening and fell approximately 75 feet from the wood plank into the shaft when he walked across. On or about 07/16/12. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) 5th floor, south side, elevator shaft: An employee was instructed to fill concrete into formwork pockets at the edge of the building and adjacent to an open elevator shaft. To access his work area, the employee removed a section of the guardrails around the elevator shaft and laid a wood plank across the shaft opening to walk across. The employee did not have fall protection and was not protected from falling into the shaft opening when he removed the guardrail for the elevator shaft to work. On or about 07/16/12. 1st REPEAT Cross Country Construction LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD, 29 CFR 1926.501(b)(4) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312809940, CITATION NUMBER 1, ITEM NUMBER 4, ISSUED ON 04/28/2009 WITH A FINAL ORDER DATE OF 05/21/2009. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATIONS AS NORMALLY REQUIRED BY 29 CFR 1903.19.
