29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) Construction Site: On or about July 31, 2012, and at times prior thereto, employees were exposed to dermal hazards while mixing various mortars containing portland cement without wearing a shirt. The employer did not ensure adequate personal protective equipment was available and used.      (b) Construction Site: On or about July 31, 2012, and at times prior thereto, employees were exposed to dermal hazards while mixing various mortars containing portland cement without rubber gloves. The employer did not ensure adequate personal protective equipment was available and used.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:     (a) Construction Site: On or about July 31, 2012, and at times prior thereto, employees were exposed to eye injuries while cutting tile without safety glasses or equivalent eye protection. The employer did not ensure adequate personal protective equipment was provided and used.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection:    (a) Construction Site: On or about July 31, 2012, and at times prior thereto, employees were exposed to electrical shock hazards while using a receptacle outlet, without a GFCI, which provided power to tools such as, but not limited to, a Ridgid drill / mixer to mix mortar.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:    (a) Construction Site: On or about July 31, 2012, and at times prior thereto, employees used a flexible cord without strain relief to provide power to the receptacle outlet used for mixing mortar. This condition exposes employees to electrical shock hazards while using such equipment.
