29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) Lot #11 Vincent Village Drive, Milton, DE - Employee observed working on a 6/12 pitch roof of a 2-story residential construction site, approximately 20-25 feet above the ground, without adequate fall protection. The employee wore a PFAS (harness), but was not tied off/secured to the anchor point as required. The employee was loading roofing materials to prepare for shingle installation. This exposed the employee to injuries from fall hazards. The violation was observed on or about June 29, 2012.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not removed from service or repaired: a) Lot #11 Vincent Village Drive, Milton, DE - Employees used a portable 32' Werner aluminum ladder with multiple damaged rungs to access the roof of a 2-story residential site. The employees were installing shingles. This exposed the employees to injures from fall hazards. The violation was observed on or about June 29, 2012.
