29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) The Residences at Towamencin Town Square - on or about June 8, 2012, employees are conducting finishing and frame carpentry work, at heights between 8 to 30 feet above unfinished grade, without any means of fall protection. b) The Residences at Towamencin Town Square, Roof - on or about June 8, 2012, employees are conducting roofing work from steeply sloped roof fields, no less than 49 feet above unfinished grade, and are also removing their fall protection equipment when transiting the roof without any means of fall protection.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: a) Residences at Towamencin Town Square, Worksite - On or about June 8, 2012, a wooden 'trash box' was being utilized to lift personnel , no less than 30 feet above grade utiliziing a Pettibone 10056 Variable Reach Rough Terrain Forklift. The box was moved horizontally while the platform was occupied by no less than two carpenters. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement is to ensure the personnel platforms are designed and certified in accordance with the manufacturer's guideline and/or per ANSI B56.6, Safety Standard for Rough Terrain Forklift Trucks, Paragraph 8.25 pertaining to the design of fork attachments and the certification of work load capacity.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms. a) Residences at Towamencin Town Square, Worksite - On or about June 8, 2012, employees while installing material to the exterior of the building were working from a wooden 'trash box' that was being lifted no less than 30 feet above grade by a Pettibone 10056 Variable Reach Rough Terrain Forklift and a standard guardrail had not been installed on the open sided front of the platform.
