29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: (a) At the project on or about August 13, 2012, and at times prior thereto, there was no assured equipment grounding conductor program or ground-fault circuit-interrupters to protect employees that used a 110 VAC Milwaukee drill, powered through an extension cord, to mix mortar in a five gallon bucket.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) At the project on or about August 13, 2012, and at times prior thereto, eye and hand protection were not used while mixing and applying Custom Blend Standard Thin Set Mortar that contain Portland cement. The mortar was used to set floor tiles.
