29 CFR 1926.54(d): Standard laser warning placards were not posted in areas in which lasers were used. On or about August 15, 2012, employees were working in and around a trench, next to and in the proximity of two Mikrofyn MLP120 Pipe Laying Lasers, which were in operation and did not have warning placards posted in the area to prevent employees from looking directly into the laser beams, exposing employees to the hazard of eye injuries. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that standard laser warning placards are posted in areas where lasers are being used.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about August 15, 2012, employees were observed holding a measuring stick in an unprotected section of the trench, which was approximately 15 feet in depth, having vertical walls that were not provided with an adequate protective system, exposing employees to cave-in hazards. THE COMMERCIAL CONSOLIDATED, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.651(k)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311315451, CITATION NUMBER 1, ITEM NUMBER 1b, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 28, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 625 E. STASSNEY LANE, AUSTIN, TX 78745. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees will be removed from the hazardous areas of cave-ins until the necessary precautions have been taken to ensure their safety.

On or about August 15, 2012, employees were working inside a trench, which was approximately 15 feet in depth, and were observed holding the measuring stick in an unprotected section of the trench having vertical walls that were not provided with an adequate protective system, exposing employees to cave-in hazards. THE COMMERCIAL CONSOLIDATED, INC.
