29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    On September 18, 2012, and times prior thereto, at this work site employees were  allowed to work in a trench excavation approximately nine feet deep by five feet wide by twenty six feet long having a hydraulic shoring system in place that did not protect employees adequately from cave-in of the excavation sides.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     On September 18, 2012, at this jobsite, and times prior thereto, employees were allowed to work in a trench approximately nine feet deep by five feet wide by twenty six feet long outside the areas of protection therefore exposing the employees to a cave-in hazard.      COMMERCIAL CONSOLIDATED, INC. WAS PREVIUOSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314579756, CITATION NUMBER 01, ITEM NUMBER 001, ISSUED ON SEPTEMBER 22, 2010 WITH RESPECT TO A WORKPLACE LOCATED AT 1110 SAM HOUSTON DR. VICTORIA, TX. AND BECAME A FINAL ORDER ON OCTOBER 05, 2010.
