29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: On or about July 19, 2013, the Werner Extension ladder used to gain access to the trench did not extend 3 feet above the top landing, exposing the employees to the hazard of falling 9 feet.
