29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a) Tiki Dining/Volcano Bar - On or about August 10, 2012, employees were exposed to a fall hazard of 13 feet when walking on an open sided elevated roof (the volcano) located on top of the volcano bar. b) Tiki Dining/Volcano Bar - On or about August 10, 2012 employees were exposed to a fall hazard of 8 feet when performing various acrobat movements upon the rim of a large blender.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) Tiki Dining/Volcano Bar - On or about August 10, 2012, employees were exposed to a fall hazard of 14 to 16 feet while performing aerial routines from a fishing hook without fall protection equipment. An aerial performer fell 14 feet to the floor while performing an aerial routine on a fishing hook that separated from an eye-bolt attached to an anchorage connector. The aerial performer's hand and wrist slipped out of the soft loop fall arrester. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
