29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Pump House Upper Level - Contractors worked on the upper level of the pump house and next to the descending stairs to the lower level. The controlling contractor did not provide a guardrail around the opening to the stairwell and contractors were exposed to a fall of 8 feet into the stairwell, on or about August 20, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
