29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely On 7 July 2012 an employee was operating a forklift and was involved in a near-miss while attempting to load a pallet to sweet feed. The employer failed to conduct refresher training for the operator involved in the near-miss.
