29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. a) Libbey Glass, Inc. - Toledo, Ohio: On or about September 11, 2012, the employer did not record a work-related fatality that occurred on August 1, 2012 on the OSHA Form 300 or equivalent for the calendar year 2012. An injury that occurred on July 31, 2012 and resulted in death on August 1, 2012, was not recorded on the OSHA 300 Log. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident a) Libbey Glass, Inc. - Toledo, Ohio: On or about August 1, 2012, the employer failed to report an employee fatality. On July 31, 2012, an employee sustained an injury at the worksite located at 1201 Buckeye St. in Toledo, Ohio, that injury resulted in the death of the employee on August 1, 2012. The employer did not report the employee fatality within 8 hours after the death. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
