29 CFR 1917.5(a):     The employer did not provide PPE to each employee required to use PPE, therefore each failure to provide PPE to an employee was considered a separate violation.    a)  302 Port Jersey Blvd., Location F602, Jersey City, NJ.    Employee was exposed to 21 foot falls from the aerial lift's bucket to the pavement below as fall protection personal protective equipment (PPE) such as a harness and lanyard or restraint belt and lanyard was not provided by his employer.                                    Violation observed on or about 08/22/2012.

29 CFR 1917.27(a)(1):     Employees other than those determined by the employer to be competent through training or experience were permitted to operate a crane, winch, or other power operated cargo handling apparatus, or power operated vehicle, or to give signals to the operator of hoisting apparatus:    a)  302 Port Jersey Blvd., Location F602, Jersey City, NJ.    Employees were exposed to struck-by and/or fall hazards as these chassis mechanics had not been determined by the employer to be competent through training or experience:  to operate the Altec AT200A Articulating Telescopic Aerial Device and to use required safety equipment such as fall restraint/protection while in the bucket; to properly position the Ford F-350 truck with attached boom outside of RTG travel lanes; and to provide signals or other notification to the RTG Operator regarding "Refer Area" movement and hoisting of containers.                                     Violation observed on or about 08/22/2012.

Employees were exposed to struck-by hazards as chassis mechanics positioned the Altec AT200A Articulating Telescopic Aerial Device mounted on the Ford F-350 truck directly in the RTG's South Travel Lane.                                     Violation observed on or about 08/22/2012.
