OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation and other respiratory hazards:    a)  O-5 Line Mixer Area - Employees were exposed to asphyxiation and other respiratory hazards from performing work in confined space without a properly set up airline system, on or about September 12, 2012. The employer utilize a Rhine airline respirator system to provide oxygen to employees where were performing a clean down of a mixer. The airline respirator system was not set up in an area free of external contaminants.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting caught-in or between a tipping forklift and the ground:     a)  Roadway outside of O-5 Line Area - Employees were exposed to crushing injuries in the event of a turn-over, from operating a forklift without wearing a seatbelt, on or about September 12, 2012. Seat belts in the forklift truck are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a tipover accident, a hazard to which forklift trucks are particularly susceptible, and that the failure to wear the seat belt that is provided in the forklift truck increases the risk of injury to the operator in the event of such an accident.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(f)(2):  Employee(s) using a tight-fitting facepiece respirator were not annually fit tested:    a)  O-5 Line Mixer Area - Employees were exposed to respiratory hazards from using full face respirators during a confined space entry without being annually fitted to ensure the respirator they were using fit properly, on or about September 12, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
