29 CFR 1910.1048(h)(2)(ii)(B): The employer did not ensure containers for contaminated clothing and equipment were labeled consistent with the Hazard Communication Standard, 29 CFR Part 1910.1200, and did not, as a minimum, include the following: DANGER; FORMALDEHYDE-CONTAMINATED [CLOTHING] EQUIPMENT; MAY CAUSE CANCER; CAUSES SKIN, EYE, AND RESPIRATORY IRRITATION; DO NOT BREATHE VAPOR; DO NOT GET ON SKIN:   a)  UF Resin Storage Tanks - On or about October 20, 2016, the employer did not ensure that containers for contaminated clothing and equipment were labeled in accordance with the 29 CFR 1910.1200 Hazard Communication Standard, paragraph (f) Labels and other forms of warning, and at a minimum the hazard warning:  DANGER; FORMALDEHYDE-CONTAMINATED [CLOTHING] EQUIPMENT; MAY CAUSE CANCER; CAUSES SKIN, EYE, AND RESPIRATORY IRRITATION; DO NOT BREATHE VAPOR; DO NOT GET ON SKIN.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.1048(m)(2)(ii): The employer did not assure that for all materials listed in paragraph (m)(1)(i) and (iv) of this section, capable of releasing formaldehyde at levels of 0.1 ppm to 0.5 ppm, labels identified that the product contained formaldehyde; list the name and address of the responsible party; and state that physical and health hazard information was readily available from the employer and from safety data sheets:   a)  UF Resin Storage Tanks - On or about October 20, 2016, for all materials capable of releasing formaldehyde at levels of 0.1 ppm to 0.5 ppm, the employer had not placed labels on the tanks of the material identifying at least that the material contained formaldehyde, listed the name and address of the responsible party, and stated the physical and health hazard information was readily available from the employer and from safety data sheets.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1910.1048(n)(3): The formaldehyde training program did not include the requirements of 29 CFR 1910.1048(n)(3)(i) through 29 CFR 1910.1048(n)(3)(vii):  a)  In the Production Area - On or about October 20, 2016, for employees exposed to formaldehyde at or above 0.1 ppm, the employer had not developed a formaldehyde training program including the following information (outlined in 29 CFR Part 1910.1048(n)(3)(i)-(vii)): i. the contents of 29 CFR Part 1910.1048 Formaldehyde, its appendices, and the contents of the Safety Data Sheets for >0.1% formaldehyde-containing chemicals on site; ii. The purpose for and description of the formaldehyde medical surveillance program, a description of the potential health hazards and signs and symptoms of formaldehyde exposures, and instructions to immediately report any adverse signs or symptoms attributable to formaldehyde exposure; iii. The descriptions of the operations where formaldehyde is present with explanations of the safe work practices expected to limit the formaldehyde exposures in each job in that operation; iv. the purpose for, proper use of, and the limitations of the provided personal protective clothing and equipment; v. instructions on the handling of spills, emergencies, and clean-up, including the neutralization of formaldehyde with ammonia [quaternary ammonium]; vi. An explanation and work practice controls for employee protection, including any necessary instruction in the use of these controls; and a review of the formaldehyde emergency procedures, including specific duties or assignments of each employee in the event of an emergency--training to be completed upon initial assignment, whenever new formaldehyde exposures are introduced, and at least annually thereafter.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1910.1048(g)(2)(ii): For employees using air-purifying respirators with chemical cartridges or canisters that do not contain end-of-service-life indicators approved by the National Institute for Occupational Safety and Health, the employer did not replace these cartridges as specified in 29 CFR 1910.134(d)(3)(iii)(B)(1) and (B)(2) or at the end of the workshift, whichever condition occurs first:  a)  UF Resin Storage Tanks - On or about October 20, 2016, the employer had not established or implemented respirator work rules which ensured that employee respirator cartridges were replaced at the intervals specified in paragraphs 29 CFR 1910.1048(g)(2)(ii)(A) and (B), meaning:  unless there is a NIOSH-approved end-of-service-life indicator (ESLI) to show when breakthrough occurs; replace cartridges after 3 hours of use in low atmospheric concentrations of formaldehyde, replace canisters every 4 hours in atmospheric concentrations up to 7.5 ppm, and replace industrial-sized canisters every 2 hours in atmospheric concentrations up to 75 ppm; or at the end of the workshift, whichever condition occurs first.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
