29 CFR 1960.8(a):     29 CFR 1960.8(a):  The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm:    a)  On or about September 17, 2012, and times prior thereto, at the DeCA commissary in Kings Bay, GA, the employer allowed warehouse workers to be elevated by a forklift while standing on pallets without fall protection to place inventory on shelving, exposing employees to falls up to 12 ft. 3 in.    b)  On or about September 17, 2012, and times prior thereto, at the DeCA commissary in Kings Bay, GA, the employer allowed warehouse workers to be elevated by a forklift while standing on pallets without fall protection to down stack taller pallets, exposing employees to falls of 7-10 feet.    ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.

29 CFR 1960.9:     29 CFR 1960.9: Employees with supervisory functions, to the extent of their authority, failed to furnish employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm. They also failed to comply with the occupational safety and health standards applicable to their agency and with all rules, regulations and orders issued by the head of the agency with respect to the agency occupational safety and health program:    a)  On or about September 17, 2012, and times prior thereto, at the DeCA commissary in Kings Bay, GA, the employer failed its supervisory responsibilities by allowing warehouse workers to be elevated by a forklift while standing on pallets without fall protection to place inventory on shelving, exposing employees to falls up to 12 ft. 3 in.    b)  On or about September 17, 2012, and times prior thereto, at the DeCA commissary in Kings Bay, GA, the employer failed its supervisory responsibilities by allowing warehouse workers to be elevated by a forklift while standing on pallets without fall protection to down stack taller pallets, exposing employees to falls of 7-10 feet.
