29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) The employee operating the Weeke #2 was exposed to noise levels at 67.17% of the action level dose (8-hour time weighted average sound level of 85 decibels) or an equivalent sound level of 87.13 dBA during 455 minute sampling period on October 16, 2012, exposing the employee to noise induced hearing loss. b) The employee operating the Nestek was exposed to noise levels at 73.60% of the action level dose (8-hour time weighted average sound level of 85 decibels) or an equivalent sound level of 87.79 dBA during 414 minute sampling period on October 16, 2012, exposing the employee to noise induced hearing loss.

29 CFR 1910.134(c)(1): The employer did not ensure that a written respiratory protection program with worksite-specific procedures was established and implemented to include the provisions of (i)-(ix), as applicable: a) The employer did not established or implemented a respiratory protection program for the employees required to wear a MSA half mask respirator while working in the paint booth. There was no written program, medical evaluations, fit-testing, or training provided to employees, exposing employees to upper respiratory irritations.
