29 CFR 1926.501(b)(13):      Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    a) Northeast side at mid-point of the structure; On or about October 4, 2012, and at times prior thereto, the controlling contractor allowed the framing sub-contractors employees to walking on/ work from the tops of the walls while setting trusses without fall protection.     b) Northeast side at mid-point of the roof; On or about October 5, 2012, and at times prior thereto, the controlling contractor allowed the framing sub-contractors employees to walking on/ work from the tops of trusses and sheathing without fall protection.      Note: Abatement certification is required.

29 CFR 1926.1052(a)(3):     Riser height and tread depth were not uniform within each flight of stairs, including any foundation structure used as one or more treads of the stairs.     a) On site at the top of the pre-fabricated stairs, On or about October 5, 2012, and at times prior thereto, the controlling employer, Biltmore Company did not ensure that all stair treads and risers were complete and had a uniform rise and run before allowing employees to use them.     b) At the top of the pre-fabricated stairs that access the second floor landing; On or about October 5, 2012, and at times prior thereto, the controlling employer, Biltmore Company did not ensure that its sub-contractor protected their employees by ensuring that the top stair had a tread.     Note: Abatement certification is required.

29 CFR 1926.1052(c)(1):     Stairways with four or more risers or rising more than 30 inches were not equipped with (i): at least one hand rail; and (ii): One stair rail system along each unprotected side or edge.     a) At the pre-fabricated stairs that access the second floor landing; On or about October 5, 2012, and at times prior thereto, the controlling employer (Biltmore Company) employee and its sub-contractors employees were not protected when using the stairs that did not have a hand rail on either side.     b) At the pre-fabricated stairs that access the second floor landing; On or about October 5, 2012, and at times prior thereto, the controlling employer (Biltmore Company) employee and its sub-contractors employees were not protected when using the stairs that did not have a stair rail system on the open side. 29 CFR 1926.1052(c)(12):     Unprotected sides and edges of stairway landings were not provided with guardrail systems.     a) At the second floor entrance landings to the left of the stairs; On or about October 5, 2012, and at times prior thereto, the controlling employer Biltmore Company employee and framing sub-contractors employees were exposed to a fall hazard when working and walking on the landing that did not have a guard rail to prevent a 9 foot fall onto concrete.
