29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. (a) W. Emerald Street and Ash Park Lane; Boise Idaho; on or about October 17, 2012, and at times prior thereto, the excavation faces on the ends of the 6' x 8' x 9.5' deep excavation were not inspected for potential falling rock and cave-in hazards, prior to employee(s) entering the excavation. (b) W. Emerald Street and Ash Park Lane; Boise Idaho; on or about October 17, 2012, and at times prior thereto, inspections and testing for hazardous atmospheres were not conducted prior to employee(s) entering the 6' x 8' x 9.5' deep excavation. (c) W. Emerald Street and Ash Park Lane; Boise Idaho; on or about October 17, 2012, and at times prior thereto, inspections and testing for hazardous atmospheres were not conducted prior to employee(s) entering the 10' x 21' x 12' deep Insertion Pit. 29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested before employees entered excavations greater than 4 feet (1.22 m) in depth. (a) Emerald Street and Ash Park Lane; Boise Idaho; on or about October 17, 2012, and at times prior thereto, employees entered a 9 1/2 foot deep excavation where there was the potential for hazardous atmospheres. (b) Emerald Street and Ash Park Lane; Boise Idaho; on or about October 17, 2012, and at times prior thereto, employees entered a 12 foot deep excavation (Insertion Pit) where there was the potential for hazardous atmospheres. Note: Abatement certification is required for these items.
