29 CFR 1926.651(h)(1): Employees worked in excavations in which there was accumulated water, or excavations in which water had accumulated, and adequate precautions were not taken to protect employees against the hazards posed by water accumulation.  a) On or about January 13, 2015 or prior thereto:  Employees were working to mark the location of the sewer line in the east portion of an excavation at a depth of 8 feet.  Standing water was present and protective measures and/or water removal methods were not present in this portion of the excavation.  Abatement certification is required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems are not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections are not conducted by the competent person prior to the start of work and as needed throughout the shift.    a) The employer does not ensure a "competent person" inspects excavations prior to the start of work and as needed throughout the shift. This violation was recently observed at the sewer replacement job located on 45th Street in Boise Idaho on January 13, 2015.  Employees were working in the east portion of an excavation at a depth of 8 feet to mark the location of a sewer line, while another employee was working at a depth of 5 feet.  Employees did not have the protection of sloping, benching and/or engineering controls such as a trench box.  Soil fissuring was present at the south wall and standing water was present at the base of the excavation.  The competent person for the site did not inspect this excavation for hazardous conditions prior to employees working in the excavation.    Titan Technologies, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 689978, citation number 1, item number 1b and was affirmed as a final order on November 30, 2012 with respect to a workplace located at Emerald St. & Ash Park Lane, in Boise, Idaho.    Titan Technologies, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 948709, citation number 1, item number 1a and was affirmed as a final order on February 3, 2014 with respect to a workplace located at Idaho State Rte. 3 and Cora East St., in Santa, Idaho.

29 CFR 1926.652(a)(1):  Each employee in an excavation is not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.    a) The employer does not protect each worker in its trenches and excavations by properly sloping the sides or using appropriate protective systems. This violation was recently observed at the sewer replacement job located on 45th Street in Boise Idaho on January 13, 2015. Employees were working to mark the location of a sewer line in the east portion of an excavation at a depth of 8 feet.  Employees did not have the protection of sloping, benching and/or engineering controls such as a trench box.  Soil fissuring was present at the south wall, and standing water was present at the base of the excavation.  The "competent person" for the site was overseeing work from the west side of the excavation.    b) The employer does not protect each worker in its trenches and excavations by properly sloping the sides or using appropriate protective systems.  This violation was recently observed at the sewer replacement job located on 45th Street in Boise Idaho on January 13, 2015.  Employees were working in the west portion of an excavation at a depth of 5 feet with unstable soils with fissure cracks and evidence of sloughing.  Employees did not have the protection of sloping, benching and/or engineering controls such as a trench box.  The "competent person" for the site was directly overseeing this work from the west side of the excavation.    Titan Technologies, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 689978, citation number 1, item number 1c and was affirmed as a final order on November 30, 2012, with respect to a workplace located at Emerald St. & Ash Park Lane, in Boise, Idaho.
