29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. a. On the construction site, an employee was operating a John Deere 410 Backhoe without wearing a seatbelt that was provided on the piece of equipment, thereby being exposed to a crushed-by hazard. b. On the construction site, an employee was operating a Komatsu 38 Mini-excavator without wearing a seatbelt that was provided on the piece of equipment, thereby being exposed to a crushed-by hazard. c. On the construction site, an employee was operating a Raygo 400 Roller compactor without wearing a seatbelt that was provided on the piece of equipment, thereby being exposed to a crushed-by hazard.
