1926.501(b)(1) "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. Located at Lot # 133 on Valerie Drive, Plain City, OH 43064: On or about February 21, 2023, an employee was riding the bucket of a CAT 336FL hydraulic excavator to access and egress an excavation while performing pipe laying work. The conditions exposed the employee to fall hazards from approximately 8.9 feet and crushing hazards from the hydraulic excavator movement.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a. Located at Lot # 133 on Valerie Drive, Plain City, OH 43064: On or about February 21, 2023, the employer did not ensure that inspections were being performed on the Griswold Machine & Engineering (GME) trench box, model no. 6M824SKE, serial no. M21040713F, that was in use, to ensure that all components were in place. A locking pin on one of the upper spreader bars was missing from the box while the box was in use to protect employees from a cave-in hazard.
