29 CFR 1926.404(b)(1)(iii): 29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: a) On or about 10/22/12, at the JC Penny roof construction site at One Galleria Dr., Cheektowaga, NY: An extension cord was plugged into each of two 120 volt-ac receptacles on an HVAC unit on the roof. Nothing was plugged into the first extension cord, but it was ready for use. A Ridgid Lithium Battery Charger, a Milwaukee Radio, and an additional extension cord were plugged into the "3-way" at the end of the second extension cord. No GFCI or assured equipment grounding program was being used. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) a) On or about 10/22/12, at the JC Penny roof construction site at One Galleria Dr., Cheektowaga, NY: Employees work with chemicals such as but not limited to Carlisle Sure-Seal Splicing Cement. The employer's written program was not maintained at the worksite. A written program should include descriptions of how the criteria for: 1. Labeling and other forms of warning; 2. Material Safety Data Sheets AND 3. Employee information and training will be met. Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled. Methods used to inform employees of the hazards associated with non routine tasks and the informing of contractors of workplace hazard must also be addressed. The written program must be made available upon request. ABATEMENT CERTIFICATION REQUIRED
