29 CFR 1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:          a.  FKM-lite-weigh up area - As of 10/23/2012 nine stainless bins and two large plastic bins containing chemicals were not labeled with appropriate hazard warnings. These chemicals included among others, NYAD 400, Wollastocoat 10222, Structol WS-280, and DIAK #3.

29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a.  Light weigh-up - As of 10/23/2012 A written respiratory protection program specific to this facility had not been developed for this and any other areas requiring respirator use, which designated a program administrator, and described the specific procedures for:     - Medical evaluations - When and how they are done and designating what clinic or licensed health care professional is used;  - Which specific protocol is used for respirator fit testing;  - Procedures and schedules for cleaning, storing, inspecting, repairing, discarding, and otherwise maintaining respirators;  - Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators;  - Training of employees in the respiratory hazards to which they are potentially exposed ;  - Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and  - Procedures for regularly evaluating the effectiveness of the program.
