29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: On or about November 15, 2012, in a trench, the employer did not enforce the proper use of an aluminum extension ladder. Employees were accessing and egressing from a trench using an aluminum extension ladder installed with the fly section at bottom and the base section at the top of the trench. This condition exposed the employees to the hazard of stumbling and falling from the ladder.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. On or about November 15, 2012, in a trench, the employer did not ensure that an aluminum ladder with visible defects was not withdrawn from service until repaired. An aluminum ladder with bent rung was being utilized by employees to enter and exit from a trench. This condition exposed employees to fall hazards of approximately 7-feet upon entry into trench.
