OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to being struck by the excavator bucket: On or about April 13, 2013 and times prior thereto, at the construction site located near the intersection of Arkansas Highway 319 and Waters Road in Austin, Arkansas, employees were exposed to struck-by hazards while working under the elevated bucket of a Kobelco Mark III Excavator.

The unprotected trench exposed employees to the hazards of a cave in.
